Noise and Nuisance Covenants

Reminder to SugarMill HOA Owners/Residents

We have had several phone calls and email inquiries as to whether or not we have Covenants specific to fireworks.  Below we have referenced our Recorded Covenants concerning Nuisance and Noise restrictions as a reminder.

Article VI – Use Restrictions

Section 2 – Nuisances.   Nothing shall be done or maintained on any Unit or Lot which may be or become an annoyance or nuisance to adjacent Owners. Any activity on a Unit or Lot which interferes with television, cable or radio reception on another Lot or in another Unit shall be deemed a nuisance and a prohibited activity.

Section 5 – Noise. Exterior noise, and noise emanating from within Units or other improvements, including without limitation, talking, singing, television, radio, record or tape player or musical instruments, shall be maintained from 11:00 p.m. until 7:30 a.m. at such volume that the noise is not audible beyond the boundaries of the Lot, or outside the boundaries of the Unit, if the Unit is in a condominium, apartment complex or similar attached dwelling from which it originates, and at all times so as not to constitute a nuisance or unreasonable annoyance to neighbors.

According to our attorney, the use of fireworks within our HOA would be a violation.

Another issue brought to mind is that a person cannot launch a firework that lands on someone else’s property without their permission.  Therefore, launching a rocket from your yard becomes a problem if it lands on the common property, or the neighbor’s yard where it would be considered trespassing and could cause damage or injury.  You would be held responsible.

Being a Military Community, we need to consider our combat veterans and the stress exploding fireworks may cause.  We also need to consider how many have beloved pets that possibly would react badly to the commotion.

2015 POOL OPENING DATES AND TIMES ANNOUNCED

• Our pool will be open May 9th and 10th, May 16th and 17th, from 10:00 am till 8:00 pm.

• Memorial Day weekend, we will be open May 23rd, 24th, and Monday May 25th, 10:00 am till 8:00 pm.

• We will be closed Tuesday, May 26th.

• Our regular schedule of being open everyday but Monday will begin Wednesday, May 27th.

Part Time Pool Attendants 2015

ATTENTION SUGARMILL PLANTATION HOA RESIDENTS

WE ARE IN NEED OF TWO PART TIME POOL ATTENDANTS FOR OUR 2015 POOL SEASON. HOURS NEEDED WILL BE 15 to 20 HOURS PER WEEK FOR EACH ATTENDANT, AT THE PAY RATE OF $9.00 PER HOUR.

QUALIFICATIONS REQUIRED:

• 18 YEARS OF AGE OR OLDER
• BE ABLE TO PASS A DRUG SCREEN AND BACKGROUND CHECK
• ATTENTION TO DETAILS, ABILITY TO CLEAN AROUND POOL AREA
• NO CHILDREN OR FAMILY MEMBERS ALLOWED AT POOL AREA WHILE ON DUTY
• FLEXIBILITY TO WORK HOURS ASSIGNED, AND IF ASKED, TO WORK OTHER HOURS
• HAVE THE PHYSICAL ABILITY TO SCRUB POOL DECK, TAKE OUT TRASH, AND CLEAN AREA
• MUST BE AVAILABLE ENTIRE POOL SEASON, FIRST OF MAY THROUGH MIDDLE OF OCTOBER

Our Annual HOA meeting will be held April 21, 2015, 6:00 pm till 8″00 pm,  in the gym at Mary Lee Clark Elementary School.  Please contact Management by way of email through our website (click here) to submit changes or updates to your contact information so we can be sure you are included in any and all correspondence that affects your property within our HOA.  Current email addresses, phone numbers, and mailing addresses,  if other than your SugarMill Residence,  are requested so our database will be accurate and ensure your notification.

Pursuant to the By-Laws of SugarMill Plantation Owners Association, Inc., each member is hereby notified the annual meeting of the Association will be held as noted above. In accordance with the By-Laws, the order of business shall be:

Registration will begin at 6:00 PM. The business meeting will begin promptly at 6:30 PM. You are encouraged to attend the annual meeting. If you are not able to attend, you may vote by proxy, form is available on our website: https://sugarmillplantation.org/forms-and-applications. If you wish to appoint a proxy, please confirm that your appointee is willing to serve and expects to attend the meeting. You may return your proxy to Sugarmill Plantation Owner’s Association by mail, P.O. Box 6004, St. Marys, GA 31558; FAX: 1-866-884-6609; or e-mail: sugarmillmanager@tds.net. Proxies can be revoked at anytime and can be presented on the day of the annual meeting by person indicated on proxy. All others must be received by close of business, April 21, 2014.

You should be aware that only those members in good standing are eligible to vote; that is dues are paid up to date and any notices of non-compliance concerning Covenants have been satisfied. No payments will be received at the meeting. Dues cannot be paid at the door.
